Terms & Conditions

Please read the following terms and conditions before clicking and downloading the product (as defined below). Clicking and downloading indicates your understanding and acceptance of the following terms and conditions. For the purpose of this terms and conditions, "YOU" shall mean your employer (or contractor or principal) which must be one of Fujitsu group companies.

  1. LICENSE AND COPYRIGHTS FUJITSU LIMITED ("FUJITSU") grants YOU a limited, nonexclusive license to reproduce and distribute the software specified below and related documentation (the "PRODUCT") to YOUR customers (the "CUSTOMERS") to the extent necessary to sell to the CUSTOMERS and support Fujitsu's ETERNUS Product.
    Name of the Software: ETERNUS Multipath Driver
  2. USE OF THE PRODUCT
    YOU shall enclose the attached "Software License Agreement" ("Agreement") between FUJITSU and the CUSTOMERS in the same parcel of the PRODUCT and shall have the CUSTOMERS comply with the Agreement.
  3. NO WARRANTY/LIMITATION OF LIABILITY
    YOU ACKNOWLEDGE AND AGREE THAT THE PRODUCT IS PROVIDED "AS IS" WITHOUT A WARRANTY OF ANY KIND. ALL EXPRESS OR IMPLIED REPRESENTATIONS AND WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT, ARE HEREBY EXCLUDED.
    FUJITSU WILL NOT PROVIDE YOU OR CUSTOMERS WITH ANY SUPPORT OR MAINTENANCE SERVICES FOR THE PRODUCT. IN NO EVENT SHALL FUJITSU BE LIABLE FOR ANY LOST REVENUE, PROFIT OR DATA, OR FOR SPECIAL, DIRECT, INDIRECT, CONSEQUENTAL, INCIDENTAL OR PUNITIVE DAMAGES, HOWEVER CAUSED AND REGARDLESS OF THEORY OF LIABILITY ARISING OUT OF THE USE OR INABILITY TO USE THE PRODUCT EVEN IF FUJITSU HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  4. TERM AND TERMINATION
    These terms and conditions shall be effective as of the date you have downloaded the PRODUCT and continue for the period until FUJITSU notifies YOU to terminate. Upon termination, YOUR license granted herein shall be automatically and immediately terminated. Further, YOU shall destroy, as requested by FUJITSU, the media and copies containing the PRODUCT.
  5. ENTIRE AGREEMENT
    These terms and conditions sets forth the entire agreement and understanding between the parties as to the subject matter hereof.
  6. NO ASSIGNMENT
    YOU shall not assign or otherwise transfer any of YOUR rights and/or obligations hereunder, in whole or in part, to any third party. Any assignment or transfer in violation of this section or any attempt to do so shall be null and void.
  7. GOVERNING LAW
    These terms and conditions shall be governed by and construed in all respects in accordance with the laws of Japan.
  8. DISPUTE RESOLUTION
    All disputes arising out of, in relation to these terms and conditions shall be brought exclusively in Tokyo District Court, Japan.
